Brian Flores Has Mystery “Smoking Gun” Evidence Against NFL
While Minnesota Vikings defensive coordinator Brian Flores gets ready for the start of the 2026 regular season, just like everyone else in the building and out at the practice fields at TCO Performance Center in Eagan, his lawyers continue to work their legal case against the league that he goes to work for every day.
If you haven’t gotten yourself caught up with the latest from ‘Flores vs NFL’, you can do that here, here and here. But in the most basic of terms, Brian Flores is accusing the league, and multiple teams, of discriminatory hiring practices and misuse of the Rooney Rule.
But for most of this saga, which is now four years old, the two sides have been busy arguing over whether or not this lawsuit can see the light of day in court.
Brian Flores thinks he has “smoking gun” in discrimination case vs NFL
Back in July, however, the Second Circuit Court made it clear when it denied the NFL’s latest appeal, that the league cannot keep Brian Flores’ from arguing his lawsuit in the federal court system. For now, that ruling has seemingly set the stage for what could be a legal battle for the ages…
But first, attorneys on both sides of the suit are busy gathering evidence, through the discovery process. And according to Mike Florio (ProFootballTalk), Flores’ team thinks it’s found an “insane” piece of evidence that could blow this case wide open.
Korn Ferry, a search firm that has assisted multiple NFL franchises in head-coaching searches over the years, has produced documents to Flores’s lawyers that include a potential smoking-gun document that could shake up the entire case.
As one source with knowledge of the document described the document, “It is insane.”

Korn Ferry is a massive search firm that helps teams every year lineup interviews for coaching and executive hires throughout the NFL. When the Minnesota Vikings began their search for a new general manager — eventually hiring Seahawks assistant GM Nolan Teasley — they used a competitor firm (Turnkey ZRG).
Well it was Korn Ferry who assisted the Las Vegas Raiders with at least one head coaching search (2025) in the past few years. And during the discovery process, Korn Ferry produced a piece of evidence to Flores’ legal team that they think could change everything.
Mystery document remains sealed… for now
This “smoking gun” document was first brought to light by sports business reporter Daniel Kaplan, who wrote in his substack Monday that, because of this new evidence, Flores’ legal team wants to add a new discrimination claim to his lawsuit.
Minnesota Vikings defensive coordinator Brian Flores wants to add a new discrimination claim to his longstanding lawsuit against the NFL and six of its teams. The move is tied to a dispute between executive search firm Korn Ferry and the plaintiffs over if a one page document obtained in third party discovery should remain sealed. It is what is in that document that led Flores to ask the New York federal court to add a new allegation to his complaint

Unfortunately, we do not know anything about this “smoking gun” that B-Flo’s lawyers have in their hands. At least for now, the document remains sealed while they try to add another discrimination claim to his ever-growing lawsuit.
Back in May, Flores expanded his civil suit to include more teams and submitted subpoenas to every NFL team in the league, except the Minnesota Vikings, in hopes of finding that one email or one document that might blow their case wide open.
Korn Ferry, Dolphins and Titans object
In order to admit this reportedly groundbreaking document into public evidence through discovery, Brian Flores needs to expand his lawsuit yet again — a move that Korn Ferry and two NFL teams (Miami Dolphins, Tennessee Titans) are trying to shut down, per Kaplan.
While the NFL has yet to submit an objection to new allegations being added, the Dolphins and Titans claim it would be more ‘practical’ for Flores to “hold off the filing of a Supplemental Complaint until a later point”. Flores’ attorneys, however, argue that’s not how discovery works.
“Korn Ferry is specifically requesting that Exhibit A remain under seal,” the company’s lawyers wrote the magistrate judge in a letter dated August 12. “Exhibit A references a confidential candidate search and was prepared by Korn Ferry in connection with a confidential search engagement with its client, the Las Vegas Raiders.”
“The Dolphins, as well as the Titans, contend that it would be more `practical’ for Mr. Flores to hold off the filing of a Supplemental Complaint until a later point,” David Gottlieb wrote. “That gets the practicalities backwards. Mr. Flores is entitled to seek redress for his newly accrued anti-discrimination claims.”

Like he has at just about every turn throughout this legal fight against his employer, I expect Brian Flores to take yet another victory here. Because his attorneys are correct.
The discovery process is meant to unlock and introduce evidence before trial, in order to make sure both sides have every piece of evidence that will be produced during court proceedings.
Without a doubt, the league and individual teams being sued by Flores are trying to do the same against him. If they found something that would change things to benefit them, you know damn well they’d move to admit it however possible.
